MSF Moon and Stars Festivals SA (hereinafter ‘organiser’) hosts, markets and/or supports the Moon&Stars Festival (hereinafter ‘event’).
A contractual relationship (exclusive) between the organiser and the purchaser of a ticket (hereinafter ‘event visitor’) is established through the purchase of an event ticket (hereinafter ‘ticket’). With the purchase of a ticket, the event visitor accepts the general terms and conditions of the organiser. The applicable version of the terms and conditions is the version published at www.moonandstars.ch/agb. Any other notices, information or conditions published by the organiser supplement these terms and conditions.
Tickets may be purchased only through the channels announced by the organiser. The purchase of tickets with the intent of resale (trade) is prohibited. The organiser will conduct appropriate controls and can block and declare invalid tickets purchased with the intent to resell. For security reasons, the organiser strongly advises against the purchase of tickets outside the official sale channels. Anyone who attempts to gain admission using copied or counterfeit tickets may be suspected of ticket misuse and prosecuted under the law. Under no circumstances is there a right to compensation for the sale price of counterfeit or copied tickets.
The right to admission and attendance is granted under the condition that the event visitor fulfils the minimum age requirement in accordance with these terms and conditions and other admission conditions of the event. If any other such conditions apply, they will be noted at www.moonandstars.ch or on the ticket.
Children under the age of 16 may be admitted only if accompanied by an adult. The organiser disclaims any liability for any damages or injuries due to non-compliance with this rule. Children under the age of six accompanied by their parents (ID required) do not require a ticket.
Event visitors are subject to the admission times announced for the respective category. The organiser reserves the right to change admission times without prior notice. The organiser bears no liability for delays in the admission process.
The organiser’s security staff will conduct security and admission checks at all official entrances and along the entire perimeter of the event grounds for the duration of the event. The event visitor is required to observe and comply with the security regulations of the organiser, the security personnel, event staff and other event workers on site.
Glass objects, aluminium, tin and spray cans, Bengal torches, pyrotechnic objects and weapons of all sorts are prohibited on the grounds. Failure to comply with this rule will result in ejection from the grounds. The organiser expressly reserves the right to pursue further legal action.
Photo, film, digital and video cameras with interchangeable lenses, audio recording devices and playback devices (with loudspeakers), and musical instruments are prohibited on the event grounds. Small pocket and digital cameras, iPods and other MP3 players are allowed.
Audio and video recordings of performances at the event are not allowed. Photographs for private use are allowed.
The organiser, security personnel and other event personnel on site are entitled to deny admission to the event visitor without compensation or eject the event visitor from the event for cause. Cause for denial of entry or ejection includes violations by the event visitor of the admission conditions, age requirements, the prohibition against audio and video recordings, or instructions and requests by the organiser or staff relating to security and/or conduct regulations.
The organiser has no influence over the composition, length and content of the concerts. The organiser reserves the right to change the programme without prior notice.
The event will take place in any weather. Poor weather conditions do not entitle the ticket holder to return the ticket.
The organiser reserves the right to cancel or postpone the event without stating a reason.
If an event is postponed, the ticket is valid for the rescheduled date irrespective of the reason for the postponement. The ticket may not be returned or exchanged.
If a concert is cancelled, there is no right to a substitute event on the same date or another date.
The organiser bears no liability for any damage incurred by the event visitor due to the cancellation of an event.
The organiser bears no liability for lost or stolen objects.
There may be a risk of hearing or other health damage due to the volume at concerts. Ear plugs will be issued free of charge at the event entrance. The organiser disclaims all responsibility for any hearing or other health damage.
Event visitors attend the event at their own risk. Any liability on the part of the organiser and its staff for property damages, personal injury or other losses (incl. indirect damages, consequential damages or lost profits) connected with the organisation or performance of the event, is explicitly excluded to the extent permissible by law.
The organiser and personnel deployed by it for the organisation and performance of the event process, use and save data from the event visitors exclusively in accordance with applicable legal provisions governing personal data protection and data security, and only to the extent this is necessary or useful for the performance of the services and, in particular, the sale of tickets, preservation of operational security and safety on the event grounds.
With their attendance of the event, the event visitor consents to being recorded or photographed. All such recordings/photos may be used by the organiser and the media outlets associated with it for publication or broadcast on the internet or other media in the context of editorial reporting and communication purposes.
The current general terms and conditions (GTC) of the organiser are an integral part of the contract established with the purchase of the ticket. If individual regulations in these event conditions become invalid, this does not affect the validity of other regulations. An invalid regulation will be deemed replaced by an effective regulation that most closely approximates the purpose and spirit of the invalid regulation. This applies in the case of regulatory loopholes.
This contract is subject exclusively to Swiss law to the exclusion of provisions concerning international civil law and the United Nations Convention on Contracts for the International Sale of Goods.
The place of jurisdiction and fulfilment is Locarno.
